Proposed Bylaws have been voted down

Dear Heritage Farms HOA Members,

Our efforts have been successful in defeating the proposed bylaws. However, new bylaws will need to replace the current developer oriented bylaws, dated Nov. 3, 2005, which you have recently been mailed by our current board. We continue to stand by our position that a 2/3 majority of the full membership (by mailed ballot) must be necessary to levy a special assessment on property owners. There are other adjustments necessary which we have identified in our conversations with you in amending these bylaws.

We have an opportunity to improve our ability in solving the bylaws issue and more. As you know, we have an opening on the board for Vice President. We feel nominee Joyce O'Neill gives us our best chance for a positive outcome on this and other HOA issues. We would kindly like you to consider voting for Mrs. O'Neill for the position. She has previously served on the board of West Bay Park in Lewes, DE for six years (2006-2012) as treasurer. This is a much larger development than Heritage Farms, totaling 364 owners. We feel she is qualified to serve as our next VP and would bring a much needed alternative point of view to our HOA Board.

Please promptly return your ballot! The board has decided to make the voting period extremely short. All ballots must be received by January 31, 2015 to be counted. You will probably not receive your ballot until at least January 20th, 2015 (no ballots will be sent out if Joyce is the only candidate). As before, with the bylaws voting, please initial your ballot, write your lot number on it and make a copy of your ballot, if at all possible. We ask you this to protect your vote for recording purposes and transparency.

A special HOA meeting will take place on February 7, 2015 at 11:00 AM at the Sussex County Library located at 121 Union St., Milton, DE (A.K.A. The Milton Library). We visited the location and are happy to report that the building is well suited for a meeting this size. There are mo

re than enough seats and they are comfortable. We found the site to be accommodating and handicap accessible and there is a parking lot directly across the street. At this meeting, the winner of the election for V.P. will be announced. The Bylaws issue is front and center on the agenda. We are currently working on an alternative set of bylaws that will appear online at the Heritage Farms Website, hopefully before the end of the month.

For those property owners not living locally and needing directions: Take Coastal Hwy (Route 1) to Route 16 and turn west toward Milton. When you reach the first traffic signal near the Food Lion shopping center, turn left onto Union St. (Route 5), then proceed down the hill into downtown Milton. The Sussex Co. Library is on the left, just a block beyond the bottom of the hill, 121 Union St.. The parking lot is directly across the street on the right. We will post photos of that area on our website to further assist you.
